    WCI for labor provider

    Definition of labor provider

    • The exclusive requirement for special type workers under the WCI Act has been abolished; and “special type workers” and “platform workers (persons who provide labor through an online platform)” have been redefined as “labor providers”.
    • A labor provider means a person who directly provides labor for the business of someone other than himself, and engages in the occupation prescribed by the Presidential Decree in consideration of the need for protection from work-related accidents, the form of labor provision, etc.
    • Workers in 18 occupations such as insurance planners who meet the above requirements are compulsorily subject to WCI according to the special case for labor providers from the time of providing labor services.
     

    Eligible scope of labor provider

    (18-1) Insurance planner
    • - An insurance solicitor who falls under any of the following items:
      a. Insurance solicitors under Article 83 (1) 1 of the 『Insurance Business Act』
      b. A person whose full-time job is to recruit postal insurance or mutual aid according to the 『Saemaeul Geumgo Act』, 『Credit Union Act』, etc.
      c. A person whose full-time job is solicitation of postal insurance under the 『Post Office Deposits and Insurance Act』
     
    (18-2) Construction machinery operator
    • A person who directly drives a construction machine registered in accordance with Article 3 (1) of the 『Construction Machinery Management Act』
     
    (18-3) Visiting lecturer
    • A person who teaches children or students by directly visiting a member’s home, such as a home-tutoring instructor or an educational teaching aid visiting instructor, according to the detailed classification of the Korean Standard Classification of Occupations
     
    (18-4) Golf course caddy
    • A person who assists in playing golf at a golf course established as a workplace sports facility pursuant to Article 7 of the 『Act on Installation and Use of Sports Facilities』 or a golf course registered as a sports facility business pursuant to Article 19 of the same Act
     
    (18-5) Courier
    • A person who is a courier according to the three classifications of the Korean Standard Classification of Occupations and falls under any of the following items:
          a. A person who carries out pick-up or delivery work as a courier service worker under subparagraph 6 (a) of Article 2 of the 『Life Logistics Service Industry Development Act』
          b. A person who carries out collection or delivery business in courier business other than item a. (referring to a business that delivers parcels through the process of collection and transportation)
     
    (18-6) Quick service driver
    • A courier according to the three classifications of the Korean Standard Occupational Classification, who performs delivery work after being requested by the business owner of the quick service business. However, those who fall under the courier driver or truck owner are excluded.
     
    (18-7) loan collector
    • A loan offeror under the proviso of Article 3 (1) of the 「Act on Registration of Lending Business, etc. and Protection of Financial Users」
     
    (18-8) Credit card member recruiter
    • A credit card member recruiter under Article 14-2 (1) 2 of the 『Specialized Credit Financial Business Act』
     
    (18-9) Substitute driver
    • A person who drives a car after receiving a request from a business operator falling under any of the following items:
          a. Substitute driver service provider(referring to the business owner of a business that drives the car to the destination by riding with the car user at the request of the car user)
          b. Consignment service provider(referring to the business owner of a business that drives the car to the destination without riding with the car user at the request of the car user)
          c. Deputy parking business(referring to the business owner of a business that parks the car on behalf of the car user at the request of the car user)
     
    (18-10) Door-to-door salesman
    • A person who conducts door-to-door sales as a door-to-door salesperson under Article 2, subparagraph 2 of the 「Door-to-Door Sales Act」 or a sponsored door-to-door salesperson under subparagraph 8 of the same Article. However, cases falling under any of the following items are excluded.
          a. In the case of self-consumption without door-to-door sales
          b. If he or she is a visiting lecturer or a visiting inspector for rental products
     
    (18-11) Rental Product Inspector
    • Rental product visit inspector according to the detailed classification of the Korean Standard Classification of Occupations
     
    (18-12) Home appliance delivery installer
    • A person who mainly performs delivery work for sales of home appliances as a home appliance installation and repair person according to the three classifications of the Korean Standard Occupational Classification, and who checks the operation status of home appliances through installation and commissioning, etc.
     
    (18-13) Truck owner
    • A person who drives a car that falls under any of the following items as a truck owner according to Article 2, Subparagraph 11 of the 『Cargo Transport Service Act』. However, delivery drivers, home appliance delivery installers, and construction site cargo owners are excluded.
          a. Trucks in accordance with Article 3 (1) 3 of the 『Automotive Management Act』
          b. a towing type car or a special work type ladder car(referring to a car used to lift items necessary for a high building for moving, etc.) among special vehicles under Article 3 Paragraph 1 Subparagraph 4 of the 『Automobile Management Act』.
     
    (18-14) Construction site truck driver
    • - A person who drives a truck that falls under any of the following subparagraphs among trucks in accordance with subparagraph 1 of Article 2 of the 『Cargo Transport Service Act』
          a. Water sprinkler or aerial work vehicle in accordance with Table 1 of 『Vehicle Registration Regulations』
          b. Straight or articulated cargo cranes in accordance with Table 1 of 『Vehicle Registration Regulations』
     
    (18-15) Software engineer
    • A software engineer under subparagraph 10 of the same Article who provides labor in the software business under subparagraph 3 of Article 2 of the 「Software Promotion Act」
     
    (18-16) After-School instructor
    • Instructor who falls under any of the following items
          a. Instructors in charge of after-school courses run by schools pursuant to Article 2 of the 『Elementary and Secondary Education Act』
          b. Instructors in charge of after-school courses under subparagraph 6 of the same Article operated by kindergartens under subparagraph 2 of Article 2 of the 『Early Child Education Act』
          c. Instructors in charge of special activity programs under Article 29 Paragraph 4 of the 『Infant and Toddler Care Act』 operated by daycare centers under Article 2 Subparagraph 3 of the same Act
     
    (18-17) Tour interpreter
    • A person who is qualified as a tour interpreter and guide pursuant to the proviso of Article 38 (1) of the 「Tourism Promotion Act」 and provides tour guide for foreign tourists
     
    (18-18) Children's school bus driver
    • A person who drives a school bus for children under subparagraph 23 of Article 2 of the 「Road Traffic Act」
